8.4. Elaph will report any such breach to the relevant law enforcement authorities and it will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Elaphmorocco Website will cease immediately.
8.5. Elaph will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Elaphmorocco Website or to your downloading of any material posted on it, or on any website linked to it.

- Content Standards
By submitting a contribution to this website (whether commissioned by Elaph or not), you agree that the following terms, conditions and content standards will apply:
(a) Elaph may at its absolute discretion remove, or disable access to, any contribution which it deems to be potentially defamatory of any person or which it deems unlawful or in violation of any third party rights. Elaph expressly excludes its liability for any loss or damage arising from the use of the Elaphmorocco Website by any person.
(b) A contribution to the Elaphmorocco Website must:
(i) be accurate (where it states facts);
(ii) be genuinely held (where it states opinion); and
(iii) comply with the law applicable in England and Wales and in any country from which it is contributed.
(c) A contribution to the Elaphmorocco Website must not:
(i) be defamatory of any person;
(ii) be obscene, offensive, hateful or inflammatory;

(xi) advocate, promote, incite any third party to commit, or assist any unlawful or criminal act;
(xii) contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism; or
(xiii) contain any advertising or promote any services or web links to other sites.
(d) Unless there is prior written agreement between you and Elaph, by submitting a contribution to the Elaphmorocco Website you agree to grant Elaph a non-exclusive licence to use that contribution. Although you will still own the copyright in your contribution, Elaph Publishing Limited will have the right to freely use, edit, alter, reproduce, publish and/or distribute the material contained in your contribution.
This licence will be free of charge, perpetual and capable of sub-licence. Elaph may exercise all copyright and publicity rights in the material contained in your contribution in all jurisdictions, to their full extent and for the full period for which any such rights exist in that material.
(e) In accordance with Clauses 12(b) and 12(c) above, you must ensure that your contribution does not infringe any copyright, database right, trade mark, moral right or other intellectual property right of any other person. By submitting your contribution to this website, you are warranting that you have the right to grant Elaph the non-exclusive copyright licence described in Clause 12(d) above.
(f) If you are not in a position to grant such a licence to Elaph, then do not submit the contribution to the Elaphmorocco Website.
(g) Elaph excludes its liability for all action it may take in response to breaches of the Terms. The actions described above are not limited, and Elaph may take any other action it reasonably deems appropriate.
- Breach
Failure by you to comply with the Terms may result in Elaph taking all or any of the following actions:
(a) immediate, temporary or permanent removal of any contribution already posted on the Elaphmorocco Website;
(b) issue of a warning to you;
(c) suspension of your right to use the Elaphmorocco Website;
(d) legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
(e) further legal action against you; and/or
(f) disclosure of such information to law enforcement authorities as Elaph reasonably feel is necessary or as required by law.
- Jurisdiction and applicable law
14.1. The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to the Elaphmorocco Website although Elaph retains the right to bring proceedings against you for breach of the Terms in your country of residence or any other relevant country.
14.2. By using the Elaphmorocco Website, you submit to the exclusive jurisdiction of the English courts.
14.3. The Terms are governed by and construed in accordance with English law.
- Trade marks
15.1. "ELAPH" is a registered Community Trade Mark (no. 3412509) the "Elaph Trade Mark" owned by Elaph Publishing Limited.
15.2. Unless otherwise stated, the Terms do not constitute a license of the Elaph Trade Mark.
- Variations to the Terms
16.1. Elaph may revise these Terms of use at any time by amending this page.
16.2. You are expected to check this page from time to time to take notice of any changes Elaph makes, as they are binding on you.
16.3. Some of the provisions contained in the Terms may also be superseded by provisions or notices published elsewhere on the Elaphmorocco Website.
- Waiver
No failure or delay by a party to exercise any right or remedy provided under the Terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or restrict the
further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall preclude or restrict the further exercise of that or any other right or remedy.
